Michael Mullavey Obtains Vacation of $157,000 Final Summary Judgment

Michael Mullavey and McArdle Franco PLLC’s commercial litigation team successfully obtained the vacation of a $157,000 Final Summary Judgment entered against a California client in Palm Beach County Circuit Court. McArdle Franco PLLC was not only able to vacate the Judgment, but also quash the Plaintiff’s purported service of process upon the client by attacking the Plaintiff’s failure to strictly comply with Florida’s substitute service of process statutes. Therefore, not only was the Plaintiff unable to attempt to enforce its judgment, but was left in the position of needing to re-perfect service upon the client to commence the litigation in earnest.
